EPIC – Sports Participation Waiver & Terms

1. Acknowledgement of Risk

I acknowledge that participation in sports and recreational activities at EPIC involves inherent risks, including but not limited to:

  • Physical injury (e.g. fractures, sprains, concussions)

  • Illness or medical conditions arising from physical exertion

  • Risks associated with equipment, playing surfaces, and other participants

  • Accidents such as falls, collisions, or other unforeseen incidents

I understand that these risks may result in serious injury or, in rare cases, death.
 

2. Code of Conduct

I agree that the participant is bound by the rules and Code of Conduct of EPIC, as amended from time to time, and acknowledge that failure to comply may result in removal from the facility or competition without refund.
 

3. Assumption of Risk

I voluntarily assume all risks associated with participation at EPIC, whether caused by negligence or otherwise. I acknowledge that participation is undertaken at my own risk.
 

4. Medical Fitness & Consent

I confirm that the participant is medically and physically fit to participate. I consent to EPIC arranging medical treatment (including ambulance transport) if required and accept responsibility for all associated costs.
 

5. Release & Indemnity

To the fullest extent permitted by law, I:

  • Release and discharge EPIC, its owners, staff, and affiliates from any liability arising from participation

  • Waive any claims for injury, loss, or damage

  • Agree to indemnify and hold harmless EPIC against any claims arising from my participation
     

6. Compliance with Safety Instructions

I agree to follow all safety instructions, policies, and directions given by staff. Failure to comply may result in removal without refund.

7. Minors

Where the participant is under 18 years of age, this agreement must be accepted by a parent or legal guardian, who accepts all risks on behalf of the minor.

8. Insurance

I acknowledge that EPIC maintains limited insurance coverage and that it is my responsibility to obtain any additional personal insurance if required.
 

9. Refunds & Credits

No refunds are provided once registration is completed.

  • Participants or teams removed from competitions are not entitled to refunds.

  • Any approved refunds may incur a $50 administration fee, and game fees for games already played will be deducted.

  • EPIC reserves the right to refuse refunds after four (4) weeks from the commencement of a season.

  • School Holiday Programs and Clinics are non-refundable, however credits may be issued at EPIC’s discretion where sufficient notice is provided.
     

10. Photography & Media Consent

I consent to EPIC taking photographs and/or video recordings for promotional purposes, including use on websites and social media.

If I object to this, I will notify an EPIC representative in writing. Requests will be considered on a case-by-case basis.
 

11. Governing Law

This agreement is governed by the laws of Queensland, including:

  • Civil Liability Act 2003 (QLD)

  • Australian Consumer Law (ACL)

  • Work Health and Safety Act 2011 (QLD)
     

12. Acknowledgement

I confirm that I have read, understood, and agree to these terms. I acknowledge that this is a legally binding agreement.
